Hi there
got a question for you. I sold some cosmetics that I know were brand new. I
had never used them. I opened a couple glosses to check for consistency and
did some visual inspection of pencils, shadows etc. Nothing was touched,
used: everything in great shape.
After almost 10 days, I got this frantic email from the buyer wanting to
know where the pkg was. I tracked it, copied it into the email with
shipping address and showed that the pkg had arrived from Calif to NE US 2
days prior (DEC 6 when it was really really cold in her area)
She never contacted me that she had retrieved the pkg.. (*and I sent
repeated emails asking) ... till a few days ago to tell me she was unhappy
because some things had obviously been used ( her words)
We exchanged a couple more emails and I still stand by that the product
was entirely new, and she wants to know what I will do. I offered her a
refund if she returns the product to me unused and I would refund the cost
of the auction.
I have not heard back from her since my offer on 12/28.
What are my obligations in this situation? Specifically, how long should I
wait with this refund offer on the table? Is there a point that this offer
gets withdrawn? My concern is that this person will come back to me 3 weeks
from now and ship it back. What do I do?

her that she has 48 hrs to respond to take advantage of the refund
offer. If she doesn't respond or leaves you a negative token just
explain in your feedback that you offered to refund her money but she
wouldn't respond. And leave her a negative in return for being a nut.
Sounds like she's just going to let it go if she hasn't responed yet.
She probably wanted you to say, "Keep the items and I'll send your money
back." She's probably done stuff like this before.

What is her feedback like, and did she happen to bid on similiar items
AFTER yours? Maybe she is trying to pull a fast one. Yes, this has
happened to me on ebay (I have 2 powerseller accounts) and when I stood
my ground, they went away. You know, if she does hit you for a negative
(for wahtever reason) you can apply to SquareTrade for a moderator to
review your case. Does your auction still have the picture? (now's the
time to add it back in if you have it). Yeah, it'll cost $20 for Square
Trade, but I refuse to be bullied. In fact, my last case, the neg was
removed and the one I left him remained.

ok. I figured if I didn't hear from her by Thurs, I would tell her
Friday that the refund offer was off the table.
that's 10 days after I made that offer and that's long enough to have
communicated with me.
or I can just forget about her and tell her if she contacts me that
it's off the table (preferred method as I really don't want to email
her any more)

I totally agree with Pam! She has almost certainly used some of the stuff
by now and she can't expect you to give a piecemeal refund.

kind of thing I'm afraid of.

I just love when buyers are late in paying and then they want it for nothing. Of course, you could tell her you will "inspect" the items and that the amount of her refund would decided upon the condition. I would also watch to see if she is turning them around and reselling anything in a partial lot.
And def block her. Who needs that kind of aggrivation?

Stevie, this is ridiculous. How can you possibly accept that lot back
from her without knowing what condition it's in?
The terms of your auction were clearly stated, and she's arguing with
them after the fact––not to mention lying about almost everything,
including receipt of the package.
To me, 4 negs in a year is not a good record. You have no further
responsibility to deal with her at all. Stop emailing her. OR send one
more email stating that as she has not responded to your suggestion, the
offer is withdrawn. Personally, I'd go the no contact route.
You're being way too generous.

to answer your question, the refund offer was made to specifically state
that the products were to be unused. She infers from her emails to me that
they haven't been used. She states she has all the original packing and
would send it back.
My inner voice is telling me she wants a partial refund.. and unless I get
that entire lot back in the original condition in which I sent it to her,
that's not happening..
don't know if I could relist it on ebay. probably could. I know that I would
request fee credit. she got a steal of a deal and she's whining over it. ..
as if 170 dollars of brand new product for under 40 dollars is such a loss
I have taken bigger losses over other things that I bought that weren't as
described but I wasn't going to whine ... since I bought the stuff and it
did fit within the parameters of what was stated

a bit more background on this "nuisance"
she bid and won an earlier auction and despite being very careful on
her own listings, didn't read the full details on mine. I have a
clause that states that for multiple item wins, it has to be closing
within 24 hours. She contacted me and explained that she was bidding on
other auctions and wanted to combine shipping. I said I would hold it.
She didn't offer to pay me then (which I should have insisted on)
she won one auction the following week. I sent her invoice, and
another email and heard nothing. Each day I sent a notices ( to her
and others ) to please pay. On day 3, I finally heard from her. She
had a "problem" with paypal. It seems that someone else had used her
paypal account and her account didn't have enough to pay for both
auctions.
My " ebay scam" alert went up. This didn't sound right.
I suggested she paypal me the $ for the first auction and send me a MO
for the other auction to be received within 7 days .. or send me a MO
for both or to use bidpay which would give her the products sooner.
I indicated over the couple of days that this email conversation took
that if she didn't put into motion payment, that I would be doing a
second chance bid on the larger auction( the second and now disputed
auction) . I even contacted the next highest bidder and she wanted the
stuff !
I guess that finally got her attention because she paypaled the money
to me immediately. (huh?? she said her cc was frozen and her acct was
frozen). less than 65 dollars for 2 auctions with products retailing at
about 300 dollars.
At no time did she indicate that any of this was a gift.
I sent it priority mail, extremely well packaged and with tracking but
no insurance. I told her at the time, that without insurance, we
aren't responsible. It went out promptly. I got this request for me
to track the item on usps.com on 12/9. I tracked, copy/pasted and
emailed her back IMMEDIATELY that the pkg had arrived there 3 days
earlier on 12/6 . (realize that this worried me because her part of the
country was getting serious snow/blizzards..... ) I copied in her
address that was on paypal and did not hear from her again.
I did keep emailing (stupidity on my part) to see if she got the boxes.
Last week, I sent her another email and she sent one back. She said she
hadn't emailed back because she had been busy with holidays, and a
death in the family and had not been home. However she did have time to
list and ship several auctions of xmas type items during this period
in question.
The email states that the items like glosses had gloss all the way to
the top of the wand; that the pencil had been used and that the shadow
had been obviously used. (I never even opened the shadow up.) She was
sure that I had used them because most of them didn't have boxes. (The

That's where the quandary is. I haven't heard from her since I sent
that offer to her on 12/28 (she got the package on 12/6 .. though she

How long do I give her to take me up on this offer? At what point
should I contact her again? What kind of deadline do I give her to
return it to me?

I found the cutest pair of shoes that closed on Xmas day and snuck out
to bid on them (and pay) while the nephews were tearing away at their

There are 2 ways to think about this. Yes, she seems like the buyer
from hell.
One, do you think you can get more money for the items (in whatever
shape they are in if/when they are returned) in a different auction.
Not the second chance bidder but a whole new auction. If they are
returned to you and you decide to refund any or part of her payment, you
can always file for the return of your fees from ebay, block her and be
done with it.
Or, you can stand by your guns and not deal with her ever again. I
think you have been more than generous and she is dragging her feet on
this one. If everything was "used" and not in "gift condition" (now
remember, that's her thinking...you never said they were boxed), she
would have returned everything immediately. You have given her more
than enough time to try to make this right.
Has any feedback been left on either side? If not, I wouldn't leave any
at this point. If you wanted to wait until the 90 days is almost up
(give a take a few, it isn't exact), leave something then...maybe she'll
be too busy to see it and wouldn't be able to respond in kind. I
certainly wouldn't be leaving any + feedback, that's for sure.
I would love to know who she is so I can block her too. Can't be too
careful out there....

PayPal has been pretty royally screwed up several times in the past two
months; it was down for three days in a row at one point, then
processed payments without posting them to the accounts (I wound up
paying three times for several items this way, though all the sellers
were incredibly thoughtful about notifying PayPal of the overpayments
immediately).
Having said all of that, the woman sounds like a complete loser. I
would do nothing at all about it unless you get the package back in
more–or–less the condition you sent it in. And I would leave very
pointed negative feedback at 11:58 p.m., 89 days after the auction was
completed (feedback can only be left for 90 days after an auction, and
you don't want to give her the chance to leave untruthful "revenge"
feedback on your account).
To whoever it was who was concerned about buying or selling on eBay
because of this horror story––I've had more than 700 transactions as a
buyer on eBay, and only 3 were less than perfect.

One thing I've started doing in my auctions is listing "All sales
final." I do this because I don't want people expecting refunds or
exchanges. I buy my items new, I and know that when they leave me they
are still in new condition.
